These terms govern your use of the homewaterpros.com website (the “Site”) and the residential water services we provide. By using the Site or requesting a quote, you agree to these terms.
Acceptance of terms
By accessing the Site, submitting a contact form, or otherwise engaging with HomeWaterPros, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Site.
Description of services
HomeWaterPros provides residential water services, including whole-home filtration, reverse osmosis, water testing, and water softening. Specifications, prices, and availability are subject to change. Any quote we provide is non-binding until confirmed in writing and accepted by you.
Eligibility
You must be at least 18 years old and able to enter into a legally binding contract to use this Site or request services. Services are offered to residential customers in our service area; we may decline service at our discretion.
Your account information
You agree that any information you submit through the Site (name, email, phone, address, message) is accurate and truthful, and that you have the right to provide it. You are responsible for the security of your own devices and email accounts.
SMS communications
If you opt in to SMS messaging on our contact form, you authorize HomeWaterPros to send you text messages about your appointment and related service communications at the phone number you provided. Message and data rates may apply. You can opt out at any time by replying STOP. See our Privacy Policy for full SMS terms.
Intellectual property
All content on the Site — including text, graphics, logos, photographs, and the underlying code — is owned by HomeWaterPros or its licensors and is protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, or create derivative works without our prior written permission.
Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these terms
- Submit false, misleading, or fraudulent information through our forms
- Attempt to interfere with or disrupt the Site, its underlying servers, or its security mechanisms
- Use automated systems (bots, scrapers, etc.) to access the Site, except for legitimate search-engine crawling
- Reverse-engineer or attempt to extract source code from the Site beyond what is publicly served
Disclaimers
The Site is provided “as is” and “as available.” While we work to keep information on the Site accurate and up to date, we make no warranties — express or implied — about its completeness, reliability, or fitness for a particular purpose. Any reliance you place on information from the Site is at your own risk.
Estimates, recommendations, and educational information shown on the Site are general in nature and do not constitute a binding service contract. Specific recommendations for your home are made only after an in-home water test and written specification.
Limitation of liability
To the maximum extent permitted by law, HomeWaterPros and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or relating to your use of the Site. Our total liability for any claim arising from your use of the Site is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100).
Nothing in these terms limits any liability that cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold HomeWaterPros harmless from any claim, demand, or expense (including reasonable attorneys’ fees) arising out of (a) your use of the Site, (b) your violation of these terms, or (c) your violation of any third party’s rights.
Third-party links and services
The Site may include links to third-party websites or integrations with third-party services. We do not control these and are not responsible for their content, privacy practices, or terms.
Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason — including if we believe you have violated these terms.
Governing law
These terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws principles. Any dispute arising under or relating to these terms or the Site shall be brought exclusively in the state or federal courts located in Hennepin County, Minnesota, and you consent to personal jurisdiction in those courts.
Changes to these terms
We may update these terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Continued use of the Site after changes take effect constitutes acceptance of the revised terms.
